Boit succession row: Sister backs man claiming to be late auditor's son

This is after the deceased’s elder sister, Josephine Boss, who is also mother to Deputy Speaker of the National Assembly, Gladys Boss came to the defence of a man claiming to be the biological son of her late brother.
Appearing before Justice Reuben Nyakundi of Eldoret High Court, Boss argued that her late brother’s son, Albert Kipchumba Lagat, whom he sired out of wedlock, deserves a share of his estate as one of the beneficiaries.
While giving her evidence in court, Boss faulted her late brother’s three children, who are the administrators of his estate, for locking out their stepbrother from the share of his properties spread in Turbo and Ainabkoi sub-counties.
She said that this was happening despite the fact that her late brother had recognized him as one of his children before his demise.
Boss also brought to the attention of the packed court that his late brother introduced her to Lagat, whom he claimed to have sired from a secret union between him and a neighbour’s wife.
The late Boit died in 2023, leaving behind several acres of agricultural land, bank deposits, a residential house in Elgon view and Kapsoya estates, respectively, on the outskirts of Eldoret City.
The children have disowned their stepbrother, claiming that he was a stranger to them, noting that their late father never introduced him to them when he was alive.
In his application, Lagat is seeking to be included as a beneficiary of his late father’s estate as he accused his stepbrothers and sister of discriminating against him in the share of the multi-million shillings’ estate.
Lagat claims that he is a biological child of the late David Kimutai Boit, as he took issue with his step-siblings for deliberately leaving him out of the list of beneficiaries, despite being aware of his existence.
He wants the court to revoke the grant of letters of administration issued to Raymond and Margaret Boit on February 7, 2025.
He told the court that he only came to know about the succession matter when he learned that the administrators had immediately started to embark on the process of subdividing and selling off the properties.
The matter is coming up for mention on October 27, 2025.
