SDT dismisses KRU objection in financial transparency row with Ngong Warriors

The Sports Disputes Tribunal (SDT) on Thursday dismissed a preliminary objection filed by the Kenya Rugby Union (KRU) that sought to block a case lodged by Ngong Warriors Rugby Club over access to the Union’s financial records.

KRU, represented by Olendo, Orare & Samba Advocates LLP, had argued that the Tribunal lacked jurisdiction to hear the matter, citing Clause 11.1.1 of its constitution which it said gave original jurisdiction to its Appeals Council.

The Union accused Ngong Warriors of bypassing internal dispute mechanisms and abusing due process.

Ngong Warriors, through Waqo, Kamwana & Monda Advocates, countered that Section 58 of the Sports Act empowers the Tribunal to hear sports-related disputes, especially where internal remedies are ineffective or biased.

The Tribunal upheld its jurisdiction and ordered KRU to make formal responses on the issues raised by September 3, 2025.

The row dates back to July 4, when Ngong Warriors, Moi University Arsonists RFC, and Meru RFC jointly demanded access to KRU’s books of accounts during a press conference at RFUEA Grounds.

They accused the Union of a lack of transparency, citing an auditor’s disclaimer in financial reports adopted at the May 30 Special General Meeting that followed the resignation of former chairman Alexander “Sasha” Mutai.

On July 16, Ngong Warriors escalated the matter to the Tribunal, demanding access to income and expenditure statements, sponsorship contracts, payrolls, remittances, and budgets for tournaments including the Safari Sevens and U20 Barthes Cup.

Chairman Victor Wachira said their campaign was not political but a principled stand for accountability in the sport.

The Tribunal will next mention the matter on September 16, 2025, to confirm compliance and give further directions.
