Man who died 9 months ago still awaits burial after brother opposed gravesite

The body of one of the late Uasin Gishu billionaire Francis Kimoso’s sons Luka Koriri Kimoso, who died nine months ago is yet to be buried due to dispute over his burial site, an Eldoret court heard.
While testifying before Justice Reuben Nyakundi, the deceased’s eldest son Morris Kimoso said that he stopped the burial of his step-brother after other family members wanted to bury him on his land.
The body is being preserved at Iten County Referral hospital morgue as Kimoso’s children fight in the corridors of justice over the share of his estate.
He told the court that his late father bequeathed him the 150-acre parcel of land as indicated in the contested will and that was why he blocked plans by his sibling to bury Luka on the property.
Morris said that he had suggested that his late brother be buried at a different land far away from his, but a section of the family members turned down the request sparking a dispute over the burial site.
According to Morris, a section of siblings insisted that the deceased, a father of five children, be laid to rest on his property and the land belongs to him.
Margaret Kimoso who is the tycoon’s first-born daughter told the Judge to help them resolve the burial dispute issue to enable them give their late brother a decent burial.
She brought to the attention of the court that their brother, had refused to allow them to bury the deceased on a section of the vast land where he had been living for more than one decade with his family before his demise in January 14, 2025.
The tycoon, who passed away 13 years ago while aged 67 was married to two wives who are now deceased and were blessed with 18 children.
The late Kimoso left behind a vast estate worth more than Ksh. 1.5 billion spread in Uasin Gishu and Elgeyo Marakwet counties.
The court directed the warring parties in the matter to file their submissions as it sets mention of the case on October 23, 2025.
