The accused, Michael Onyango Ochieng, popularly known as “Jonyo,” was convicted of assaulting and robbing John Okaka on May 11, 2024, within the Manyatta area of Kisumu.
According to court documents, the victim was attacked at around 7am by three men armed with a crowbar, who struck him on the head and made away with two mobile phones and cash.
"Prosecution witnesses, including neighbours, medical officers and investigation officers, testified and presented evidence in court that placed the accused person at the scene of crime, with some positively identifying him by name as a known individual in the area," said the Office of the Director of Public Prosecutions in a statement.
"The victim, who sustained head injuries, also identified Ochieng as one of his assailants."
According to the ODPP, medical evidence presented in court confirmed that Okaka suffered a wound consistent with blunt force trauma. An identification parade conducted by police further reinforced the case against Ochieng.
"Despite denying the charges and claiming he had been arrested at a kiosk unrelated to the crime, the court ruled that the prosecution, through Raymond Nyonges, had proven its case beyond a reasonable doubt," the ODPP added.
Winam Law Courts Principal Magistrate Dennis Ogal, while delivering the judgment, stated that the evidence left no doubt that Ochieng was among those who assaulted and robbed Okaka.
