During the mention of the case, lawyer Evans Ondieki described the case as a “circus” that has dragged on for four years.
He told the court that the ODPP had only just informed them this morning that they had been served with the case file.
“They have been detaining the subject incommunicado for four years. I propose that you issue a warrant of arrest against the IG to bring them to court because they are not here and there has been no communication,” Ondieki said.
The Office of the Director of Public Prosecutions (ODPP) confirmed that it is keen on establishing the whereabouts of Mbijiwe, emphasizing that as an officer it has a duty to ensure accountability in such cases.
The family argued that the court had previously ordered the authorities to produce Mbijiwe, but the orders have not been obeyed, prompting their call for the issuance of warrants.
Despite the family’s request, the court declined to issue the warrants of arrest, noting that the matter would be mentioned next week for further directions.
