The High Court has dismissed a petition challenging the nomination and appointment of Noordin Haji as Director of the National Intelligence Service (NIS), affirming that the President’s choice in appointing key public officers is discretionary and protected under the Constitution.
"The petition lacks merit and is hereby dismissed," ruled Justice Lawrence Mugambi.
The court ruled that the petitioners’ arguments, which alleged that unresolved cases before the high court and Public Service Commission should have disqualified Haji, were misplaced.
It noted that judicial intervention is only justified if the President acts outside the constitutional framework, and any interference in the appointment process would amount to judicial overreach.
Responding to the petition, the NIS Director stated that the allegations were unsubstantiated and that his appointment complied fully with the NIS Act.
