In a letter dated October 9, 2025, signed by UDA Disciplinary Committee Chairperson Charles Njenga, the party said it had received information and evidence showing that Khalwale participated in the campaigns of Malava's Democratic Action Party of Kenya (DAP-K) candidate Seth Panyako instead of UDA's David Ndakwa.
This, the ruling party indicated, contravened the party's Constitution and interests, which sponsored him to the Senate.
“Your said activities clearly demonstrate allegiance to another political party and constitute conduct unbecoming and disloyalty to the United Democratic Alliance Party,” the letter reads in part.
The committee directed Khalwale to respond within 14 days, explaining why disciplinary action should not be taken against him.
The party also indicated that, based on his response, formal disciplinary proceedings may follow, and he would be entitled to represent himself or appear with an advocate before the committee.
The letter comes barely a week after Khalwale vowed to support Panyako, a move that critics questioned, whether he had distanced himself from UDA.
“Wamalwa anatembea na Kalonzo Musyoka, Fred Matiang’i, Rigathi Gachagua wanamchekelea kwamba wewe uko na nani. Wamalwa, sikia, kuanzia leo ambia wenzako you will never walk alone, kwa sababu uko na bullfighter Senator Boni Khalwale,” Khalwale stated in Malava Constituency on October 8, 2025.
The Malava seat became vacant in February 2025 after the late MP Malulu Injendi died while receiving treatment in Nairobi.
