Kasipul parliamentary aspirant Ogada seeks nullification of ODM primaries

Newton Onyango Ogada, a parliamentary aspirant in the Kasipul by-elections has contested the Orange Democratic Movement (ODM) party nominations in Kasipul Constituency. 

Ogada has written to the Political Parties Disputes Tribunal seeking to nullify the exercise.

Filed under certificate of urgency, Ogada wants the Tribunal to issue orders stopping the Independent Electoral and Boundaries Commission (IEBC) from accepting or gazetting the Boyd Were as ODM’s duly nominated candidate for Member of Parliament in the upcoming Kasipul by-election scheduled for November 2025.

Through his lawyers, Ogada is seeking injunctions restraining ODM officials and the IEBC from recognizing the results of the nomination exercise conducted on September 24, 2025. 

He argues that the process was marred by violence, fraud, and blatant disregard of party rules and electoral fairness.

In his supporting affidavit, Ogada claims that between 2:00 pm and 2:30 pm on polling day, a group of armed youth allied to his rival stormed Beril Medical Centre, where he and his team had retreated. They allegedly smashed windows, broke medical equipment, and vandalized vehicles, effectively barricading him for over two hours and preventing him from coordinating his agents or monitoring the exercise.

He further alleges widespread electoral malpractice, including multiple voting, itinerant voters casting ballots in different stations, underage children participating, and the absence of a verifiable party membership register.

According to him, presiding officers resorted to ad hoc identification using only national IDs, a practice that enabled non-members and minors to vote.

Ogada also accuses presiding officials and clerks of being partisan allies of the Were dismissing complaints lodged by his team and in some cases expelling his agents from polling stations. He adds that ballot materials arrived late in several stations but voting still closed early, disenfranchising many voters.

In addition, the applicant claims that polling stations were merged or relocated without notice, incident registers were not properly maintained, and tally sheets were inconsistently filled. He also says some results were announced verbally without transparency.

Ogada lodged an appeal with the party’s internal tribunal on September 25, but the case was dismissed on September 29, with a copy of the ruling only supplied the following day. He now seeks redress at the Political Parties Tribunal. PPDT directed that the matter be heard on Monday October 6.
