Judge declines to halt Banissa by-election, orders fast-tracked hearing

High Court Judge Lawrence Mugambi has declined to issue conservatory orders to stop the Banissa by-election.

Instead, the judge directed that the matter be heard on a priority basis and ordered that the application and the main petition be consolidated and heard together.

In the case, a voter from Banissa Constituency, Mohamedin Mohammed, has moved to court seeking orders to nullify the candidacy of UDA’s Ahmed Maalim Hassan, arguing that the candidate holds dual citizenship.

The court directed the respondents to file and serve their responses to the application by tomorrow. The petitioner may file a further affidavit if necessary.

Justice Mugambi further ruled that no extension of time will be allowed and that any filings made outside the set timelines will not be accepted by the court.

The judge directed that judgement in the matter will be delivered before November 27, provided all parties comply with the directions issued today.
