A man has
been sentenced to life imprisonment for assaulting and defiling his 12-year-old
daughter in Nakuru County.
Appearing
before Nakuru Law Courts Senior Principal Magistrate Vincent Adet, the accused
was found guilty of the heinous crime and slapped with the sentence.
The
prosecution proved the case beyond reasonable doubt after availing six
witnesses who testified against the child’s father.
“An adult
male offender was convicted of the offence of incest contrary to Section 20 of
the Sexual Offences Act No. 3 of 2006. Prosecution, led by Ms Adeline Rogito
and Mr Ismael Yunis, successfully established the case against the accused,” the
Office of the Director of Public Prosecutions (ODPP) stated.
The court
heard that on November 9, 2024, at midday, the convict forced who was alone
with the minor, forced her to commit the act with him, and after she refused,
he hit her then went ahead to defile her before threatening her not to tell
anyone.
The Magistrate,
in sentencing the accused, underscored the gravity of the act, even though the
man was a first-time offender, stating that, “The crime outweighed the
mitigating factors.”
The court further noted that the offence was
committed against a vulnerable child within the sanctity of a family setting,
constituting an aggravating breach of trust and deemed the ultimate penalty of
life imprisonment necessary given the brutality and the familial context of the
crime.
