Appearing before Trial Magistrate Rose Ndobi on Tuesday for the mention of his separate hate-speech case, Waititu—through his lawyer—said he had obtained a Ksh. 53 million bank guarantee, a key requirement in his bid to secure release. He has been in custody since February this year.
The court noted that upon payment of the Ksh. 53 million guarantee, Waititu may be freed, as his earlier bond terms in the hate-speech matter remain valid.
Magistrate Ndobi scheduled the hearing of the hate-speech case for January 15, 2026.
Waititu is accused of making inflammatory remarks on September 29, 2024, at Ruiru Stadium in Kiambu County.
According to the charge sheet, the former governor allegedly directed statements at groups including hustlers, market vendors, boda boda operators, clergy, and teachers—remarks said to be intended to provoke a breach of peace and imply violent consequences against political figures.
