EACC challenges ODPP’s bid to drop forgery, corruption case against UoN staffer

The Ethics and Anti-Corruption Commission (EACC) has opposed an application by the Office of the Director of Public Prosecutions (ODPP) seeking to withdraw a corruption case against Daniel Brian Ouma Okeyo, a senior University of Nairobi official accused of forging academic documents and unlawfully obtaining more than Ksh.32 million in salaries and benefits.

When the matter came before the Anti-Corruption Court on Tuesday morning, the prosecution informed the court of its intention to terminate the proceedings.

However, EACC lawyers immediately objected to the move, arguing that the withdrawal would be premature given that the accused still enjoys conservatory court orders halting the case.

According to the EACC, the orders—granted on July 9 this year—remain in effect following petitions filed by Okeyo in both the High Court and the Labour Court, where the EACC and ODPP are listed as parties.

“The said petitions have not been withdrawn, and it would only be appropriate for the accused to first withdraw those matters before any steps are taken in this case,” an EACC representative told the court.
The Commission further maintained that the petitions have a direct bearing on the ongoing criminal proceedings, cautioning that any attempt to terminate the case before their resolution would undermine the judicial process.

In response, the prosecution indicated that discussions between the involved parties were underway to address the pending legal issues, assuring the court that the case would only be withdrawn once the matters are conclusively settled.

The court subsequently directed that a ruling on the application to withdraw will be delivered on October 30.

Okeyo is facing multiple charges, including forgery of academic credentials and unlawful acquisition of public property, totaling more than Ksh32 million.

The alleged offenses are said to have occurred between 2015 and 2025, during his tenure in various senior positions at the University of Nairobi, including Deputy Director (Fundraising, Donor Relations and Partnership), Director of Advancement, and Acting Chief Operations Officer.
