Dr Mutiso murder: DCI granted four days to hold two suspects

The DCI had sought seven more days to detain the two suspects, Daniel Mwangi and Kevin Kinuthia, citing fresh information obtained from them and other suspects, pending forensic and financial reports, and the identification of additional witnesses.

However, the court granted investigators four days to complete the outstanding inquiries.

In a supporting affidavit, homicide investigator Romana Odour told the court that the suspects were arrested on August 7, 2026, and were subsequently presented in court on August 10, when investigators obtained an initial 30-day detention order.

The investigator said the probe had not been concluded because the two suspects had provided new information that required further investigation.

The DCI is also awaiting cybercrime and forensic reports from the National Forensic Laboratory. Detectives say the reports will help them further interrogate the suspects over information recovered from mobile phones seized during the arrests.

Investigators are similarly waiting for a financial report from the Financial Reporting Centre to assist them in probing the financial aspects of the case.

The court was further told that detectives had identified additional witnesses following the interrogation of suspects. Some of the witnesses are outside Nairobi and are yet to record their statements.

The investigation has also widened, with the DCI saying some alleged accomplices are still at large while others are in custody.

Several related suspects have already been placed in separate proceedings, while Elijah Kibelion Kimoi has been formally charged with murder in Milimani HCCRCE No. 005 of 2026 and is scheduled to take plea on September 23.

DCI cites flight risk and safety concerns

The investigators had argued that releasing the two suspects before completion of the probe could jeopardise the investigation, saying there was a possibility they could abscond.

The DCI also raised concerns over the safety of the suspects, telling the court that the case had generated significant public interest and outrage.

According to the affidavit, the identities of the suspects are now known to members of the public and the deceased's family, creating fears that they could face retaliation or mob justice if released.

The investigators argued that the continued detention was necessary to allow them to pursue additional suspects, record statements from new witnesses, analyse forensic reports and follow up financial and other investigative leads.

The State had asked the court to treat the circumstances as compelling reasons under Article 49(1)(f) and (g) of the Constitution and Section 36A of the Criminal Procedure Code.

Dr Mutiso was shot and killed on the morning of July 29, 2026, in Nairobi's Upper Hill area. 

Rose Mbithe Mulwa and her two children, Chris Mulo and Angella Mulo, are among the suspects accused of orchestrating the hit due to a long-running family property dispute. 

Police Constable Elijah Kimoi and Collins Bett Kiplangat, alongside civilian accomplices, are also accused of planning the murder.
