DPP directs bribery charges against prosecutor Samuel Kiarie

In a statement issued on Wednesday, the Office of the Director of Public Prosecutions (ODPP) said it had reviewed an inquiry file forwarded by the Ethics and Anti-Corruption Commission (EACC) concerning bribery allegations against Kiarie, a prosecutor stationed at the Makadara Law Courts.
“Upon an independent evaluation of the evidence presented, the DPP has established that there is sufficient and credible evidence to sustain criminal charges against Mr. Kiarie,” the statement read.
According to the ODPP, Kiarie will face three counts of receiving a bribe contrary to Section 6(1) as read together with Section 18 of the Bribery Act. The DPP has directed that he be arraigned before a court of competent jurisdiction to answer to the charges.
“Consequently, the DPP has approved three counts of receiving a bribe and directs that the accused be arraigned before a court of competent jurisdiction,” the statement added.
The prosecution of a state prosecutor marks a significant development in efforts to restore public confidence in the criminal justice system. Makadara Law Courts handle a high volume of criminal cases in Nairobi, making integrity among officers critical to the administration of justice.
The ODPP emphasized that no one is above the law and will enforce its constitutional mandate to uphold the rule of law and safeguard public interest.
“No individual, regardless of office, rank or position, is above the law. The ODPP will not hesitate to take decisive action against any officer who undermines the integrity of the Criminal Justice System,” the office stated.
