Court halts transfer of Makongeni Bus Park to Posta Kenya

In the ruling, Justice J.A. Mogeni ordered a temporary stay of execution pending the inter partes hearing of the case between Postal Corporation of Kenya and the County Government of Kiambu, set for November 20, 2025.
The order followed an application filed by the County Government of Kiambu seeking to stop the takeover, arguing that the property in question remains vital for public use and local transport operations.
The court directed that the application be served upon the respondents within five days and that responses be filed within a similar period.
As a result of the interim stay, matatu operators and traders at the Makongeni Bus Park will continue operating freely and without disruption until the matter is conclusively determined.
The dispute centres on Thika Municipality Block 2/840 and Kiambu Municipality Block 2/284, parcels previously utilised by both the County Government and the Postal Corporation.
In a related development, the County Government of Kiambu, through a letter dated March 26, 2025, offered compensation to the Postal Corporation for the two parcels of land at a total value of Ksh.315,182,250.
The letter, signed by Salome Wainaina, the County Executive Committee Member for Lands, Housing, Physical Planning, Municipal Administration, and Urban Development, outlined that the county would pay Ksh.100 million for Kiambu Municipality Block 2/284 and Kshs. 215 million for Thika Municipality Block 2/840.
The offer, which was also copied to Kiambu Governor Kimani Wamatangi and Information Cabinet Secretary William Kabogo, emphasised the county’s commitment to resolving the land ownership dispute amicably and maintaining uninterrupted public service at the bus park.
The court’s decision comes as a relief to local traders and transport operators who had expressed concern over possible eviction following the earlier ruling.
