Magistrate Paul Mutai ruled that Sammy Murigi Maina will remain in custody until key prosecution witnesses testify, citing compelling reasons to deny him bail at this stage of the proceedings.
The court noted the slow pace of the trial, with only one witness appearing in court today for hearing, but said the delay should not prejudice the proceedings.
The prosecution was directed to produce eyewitnesses and investigate claims that the investigating officer was sabotaging the hearings.
The victims had alleged that the investigating officer was frustrating the progress of the case, prompting calls for the officer to be brought to court to clarify the allegations.
In his application, Maina’s side argued that the accused was suffering in custody and sought a review of the bail decision. However, the magistrate said he was not persuaded to review bail at this stage.
The matter was scheduled for November 9, when the prosecution is expected to proceed with its witnesses
Maina was arrested nearly two months after the June 3, 2026, crash and subsequently appeared in court to face multiple traffic related charges.
He is charged with three counts of causing death by dangerous driving, contrary to Section 46 of the Traffic Act, Cap 403 of the Laws of Kenya.
The prosecution alleges that Maina was driving an Isuzu minibus, registration number KDU 887C, operated by Risen Sacco, along Enterprise Road near KCB Bank at about 8pm when the crash occurred.
