The posts falsely linked the legislator to the death and disappearance of Munyuki High School Principal Simon Isiaho Shange.
The interim order, issued pending the full hearing of the case, followed an application filed by MP Nabwera through his lawyer, Danstan Omari.
The court ruled that Asiviela must apologize for the “malicious, false and unqualified publications” that were widely circulated on platforms including Kakamega Post, Malava Online, and Lugari Watchdog.
According to court documents, the posts claimed that Nabwera was involved in the principal’s disappearance and death — allegations the MP described as baseless and politically motivated.
In his affidavit, Nabwera said the posts incited the public, with some threatening to “occupy” and vandalize his home in Lugari, putting his family at risk and damaging his reputation.
Through his lawyers, Nabwera sought urgent conservatory orders to stop further defamatory publications and demanded Ksh.20 million in compensation for reputational harm.
The court certified the matter as urgent and granted the request for a public apology.
The order compels Asiviela to retract the posts and issue a public apology to the MP.
