A 37-year-old man has been sentenced to life imprisonment after a Kabarnet court found him guilty of defiling his 10-year-old neighbour in Songwot village, Tiaty East, Baringo County.
According to the prosecution, the
incident occurred on December 20, 2024, when the victim and her two-year-old
brother were left at home by their mother, who had gone to attend a cultural
event.
The court heard that later that
night, the convict broke into the house where the children were asleep.
The girl positively identified him using a spotlight before he
kicked it away and violently attacked her.
Despite her attempts to raise alarm, he overpowered her and
threatened to kill her if she ever revealed the ordeal, before fleeing into a
nearby thicket.
The prosecution presented seven
witnesses, including the victim, whose testimony was corroborated by medical
examination reports and other crucial evidence.
In their submissions, prosecutors
underscored the seriousness of the offence and urged the court to impose a
stiff penalty.
While handing down the life
sentence, Magistrate Caroline Ateya highlighted the violent nature of the act,
the deep psychological trauma inflicted on the minor, and the mandatory
provisions of the law on such offences.
The Office of the Director of
Public Prosecutions (ODPP) welcomed the judgment, noting that it not only delivered
justice to the victim but also sent a strong message of deterrence against
crimes of sexual violence.
